{"id":8472,"date":"2023-01-24T06:00:31","date_gmt":"2023-01-24T11:00:31","guid":{"rendered":"https:\/\/www.ccts-cprst.ca\/?p=8472\/"},"modified":"2025-01-24T17:02:40","modified_gmt":"2025-01-24T22:02:40","slug":"decision-rendue-a-ica-communications","status":"publish","type":"post","link":"https:\/\/www.ccts-cprst.ca\/fr\/decision-rendue-a-ica-communications\/","title":{"rendered":"La CPRST exige qu\u2019un fournisseur de services non coop\u00e9ratif indemnise son client"},"content":{"rendered":"<p><strong>ICA\u00a0Canada facture \u00e0 tort des frais \u00e0 un client apr\u00e8s l\u2019annulation d\u2019un service et parce qu\u2019il a demand\u00e9 de l\u2019aide pour r\u00e9gler le diff\u00e9rend. <\/strong><\/p>\n<p><strong>Ottawa (le 24\u00a0janvier\u00a02023) \u2013 <\/strong>La <em>Commission des plaintes relatives aux services de t\u00e9l\u00e9com-t\u00e9l\u00e9vision <\/em>(CPRST) a rendu <a href=\"https:\/\/www.ccts-cprst.ca\/wp-content\/uploads\/2023\/01\/CCTS-1232433-Decision-2022.pdf\">une d\u00e9cision<\/a> concernant le fournisseur de services internet ICA\u00a0Canada\u00a0On-Line\u00a0Inc. (ICA), dans laquelle elle exige que le fournisseur indemnise une petite entreprise cliente et annule des frais inappropri\u00e9s.<\/p>\n<p>Lorsque la CPRST enqu\u00eate sur une plainte, le fournisseur vis\u00e9 est tenu de fournir des renseignements et des documents pour d\u00e9montrer qu\u2019il a raisonnablement rempli ses obligations envers le client. ICA a refus\u00e9 de collaborer \u00e0 l\u2019enqu\u00eate de la CPRST et n\u2019a fourni aucun renseignement ni document pour expliquer sa conduite. La CPRST a poursuivi son enqu\u00eate en se fondant sur le site Web de l\u2019entreprise, ses modalit\u00e9s de service et la preuve fournie par le client. La CPRST a ensuite rendu une d\u00e9cision officielle.<br \/>\n<strong><br \/>\nR\u00e9sum\u00e9 de la plainte. <\/strong>En 2022, une petite entreprise cliente a donn\u00e9 \u00e0 ICA un pr\u00e9avis de 60\u00a0jours pour annuler les services internet que lui fournissait ce fournisseur. Les modalit\u00e9s de service d\u2019ICA exigent que les clients donnent un pr\u00e9avis de 60\u00a0jours en cas d\u2019annulation. ICA n\u2019a pas annul\u00e9 le service \u00e0 la date d\u2019annulation demand\u00e9e. Elle l\u2019a retard\u00e9e d\u2019un mois et a factur\u00e9 au client un mois de service suppl\u00e9mentaire. De plus, le fournisseur a \u00e9mis une autre facture de 1\u00a0299\u00a0$ apr\u00e8s que le client a demand\u00e9 l\u2019aide d\u2019un organisme de traitement des plaintes ind\u00e9pendant. Le client a refus\u00e9 de payer cette facture.<\/p>\n<p><strong>Constatations faites par la CPRST concernant la demande d\u2019annulation du client. <\/strong>La CPRST a conclu que le client avait fourni un pr\u00e9avis d\u2019annulation appropri\u00e9, et qu\u2019ICA aurait d\u00fb y donner suite. La d\u00e9cision de la CPRST exige donc qu\u2019ICA rembourse le client pour le mois de service suppl\u00e9mentaire. La CPRST a de plus not\u00e9 que la politique d\u2019annulation de 60\u00a0jours d\u2019ICA est en violation d\u2019une r\u00e8gle du Conseil de la radiodiffusion et des t\u00e9l\u00e9communications canadiennes (CRTC) qui interdit de telles politiques d\u2019annulation. La <a href=\"https:\/\/crtc.gc.ca\/fra\/internet\/codesimpl.htm\" rel=\"noopener\">r\u00e8gle du CRTC<\/a> donne aux clients le droit d\u2019annuler leur service <u>en tout temps<\/u>, sur avis \u00e0 leur fournisseur.<\/p>\n<p><strong>Constatations faites par la CPRST concernant les frais factur\u00e9s relatifs \u00e0 la plainte du client.<\/strong> Bien que les modalit\u00e9s de service d\u2019ICA indiquent qu\u2019elle facturera au client \u00ab\u00a0jusqu\u2019\u00e0 450\u00a0$\u00a0\u00bb si un client demande une enqu\u00eate ou conteste les conditions de l\u2019entreprise, la CPRST a conclu qu\u2019il n\u2019est pas permis de facturer <u>des<\/u> frais (peu importe les frais) qui p\u00e9nalisent un client apr\u00e8s que ce dernier a demand\u00e9 un recours. La CPRST avait trait\u00e9 de cette question dans <a href=\"https:\/\/www.ccts-cprst.ca\/fr\/decision-rendue-a-ica-canada-on-line-inc\/\">une d\u00e9cision ant\u00e9rieure contre ICA <\/a>en 2020. Puisque les frais relatifs \u00e0 la plainte ne sont ni justes ni raisonnables, la CPRST exige dans sa d\u00e9cision qu\u2019ICA annule les frais de 1\u00a0299\u00a0$ relatifs \u00e0 la plainte et confirme qu\u2019elle a cess\u00e9 toute activit\u00e9 de recouvrement et d\u2019\u00e9valuation de cr\u00e9dit pour ces frais et qu\u2019elle a apport\u00e9 toutes les corrections n\u00e9cessaires.<\/p>\n<p><strong>Mesures demand\u00e9es par la CPRST. <\/strong>En vertu des <a href=\"https:\/\/www.ccts-cprst.ca\/fr\/codes-statistiques-et-rapports\/code-de-procedures\/guide-annote-sur-le-code-de-procedures\/\">r\u00e8gles de proc\u00e9dure<\/a> de la CPRST, ICA est tenue d\u2019effectuer un remboursement pour le mois de service factur\u00e9 en trop et d\u2019annuler les frais relatifs \u00e0 la plainte, \u00e0 d\u00e9faut de quoi la CPRST prendra d\u2019autres mesures d\u2019application.<\/p>\n<p>\u00ab Il s\u2019agit d\u2019un exemple clair d\u2019un fournisseur de services qui ne respecte pas ses obligations envers le client, <strong>affirme Howard Maker, commissaire et directeur g\u00e9n\u00e9ral de la CPRST<\/strong>. Les Canadiens ont le droit d\u2019acheminer leurs plaintes concernant les services de t\u00e9l\u00e9phone, d\u2019internet et de t\u00e9l\u00e9vision \u00e0 la CPRST, et ce, sans frais et sans crainte d\u2019\u00eatre p\u00e9nalis\u00e9s.\u00a0\u00bb<\/p>\n<p>\u00ab\u00a0Il y a des cons\u00e9quences \u00e0 ne pas respecter les r\u00e8gles, poursuit M.\u00a0Maker. \u00c9tant donn\u00e9 que le client a accept\u00e9 notre d\u00e9cision, le r\u00e9sultat de notre enqu\u00eate est ex\u00e9cutoire et l\u2019ICA doit mettre en \u0153uvre ces mesures correctives.\u00a0\u00bb<\/p>\n<p><a class=\"button\" href=\"https:\/\/www.ccts-cprst.ca\/wp-content\/uploads\/2023\/01\/CCTS-1232433-Decision-2022.pdf\" target=\"_blank\" rel=\"noopener\">Lire la d\u00e9cision compl\u00e8te<\/a><\/p>\n<p>__<\/p>\n<p><strong>\u00c0 propos de la\u00a0CPRST <\/strong><\/p>\n<p>La CPRST est l\u2019organisme national et ind\u00e9pendant du Canada qui s\u2019occupe de r\u00e9gler les plaintes des clients relatives aux services de t\u00e9l\u00e9communications et de t\u00e9l\u00e9vision, de fa\u00e7on \u00e9quitable, et ce, gratuitement.
