{"id":1252,"date":"2015-07-31T16:18:44","date_gmt":"2015-07-31T20:18:44","guid":{"rendered":"https:\/\/www.ccts-cprst.ca\/?p=1252\/"},"modified":"2018-10-12T14:00:35","modified_gmt":"2018-10-12T18:00:35","slug":"brama-manque-a-ses-obligations-envers-ses-clients-et-le-cprst","status":"publish","type":"post","link":"https:\/\/www.ccts-cprst.ca\/fr\/brama-manque-a-ses-obligations-envers-ses-clients-et-le-cprst\/","title":{"rendered":"Brama manque \u00e0 ses obligations envers ses clients et le CPRST"},"content":{"rendered":"<p><strong>Ottawa, le 31 juillet \u2013\u00a0<\/strong>Aujourd\u2019hui, le Commissaire aux plaintes relatives aux services de t\u00e9l\u00e9communications a rendu une\u00a0<a href=\"https:\/\/www.ccts-cprst.ca\/wp-content\/uploads\/2017\/06\/Decision-PM-CCTS-579776-final.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">d\u00e9cision<\/a>\u00a0au sujet d\u2019une plainte \u00e0 l\u2019endroit de Brama Telecom, une compagnie de Toronto qui fournit des services de t\u00e9l\u00e9phonie r\u00e9sidentielle, d\u2019internet et de t\u00e9l\u00e9vision \u00e0 une client\u00e8le de particuliers et de petites entreprises.<\/p>\n<p>Cette d\u00e9cision intervient au moment o\u00f9 Brama se trouve d\u00e9j\u00e0 en violation de ses obligations \u00e0 l\u2019endroit de ses clients et du CPRST. En f\u00e9vrier et mars 2015, Brama a factur\u00e9 des frais mensuels \u00e0 un client \u00e0 huit reprises au lieu de deux. Brama a obtenu l\u2019argent du client par le biais de pr\u00e9l\u00e8vements automatiques. Brama n\u2019a pas rembours\u00e9 les montants surfactur\u00e9s au client, qui s\u2019est plaint au CPRST.<\/p>\n<p>Notre d\u00e9cision ordonne \u00e0 Brama de rembourser les montants surfactur\u00e9s. La d\u00e9cision a un caract\u00e8re ex\u00e9cutoire \u00e0 l\u2019encontre de Brama. R\u00e9cemment, le CPRST a aussi \u00e9mis deux recommandations que Brama devait appliquer mais qui ne l\u2019ont pas \u00e9t\u00e9. Brama a ainsi viol\u00e9 ses obligations \u00e0 l\u2019\u00e9gard des clients vis\u00e9s et du CPRST. Dans un de ces cas, Brama a pr\u00e9lev\u00e9 onze paiements du compte d\u2019un client sur une p\u00e9riode de deux mois, au lieu des deux paiements requis. Dans l\u2019autre cas, Brama a pr\u00e9lev\u00e9 le nombre pr\u00e9vu de paiements mais pour un montant plus \u00e9lev\u00e9 que celui auquel le client avait consenti. Dans chacun de ces cas, le CPRST a recommand\u00e9 que Brama compense les clients pour les montants surfactur\u00e9s. Les clients ont accept\u00e9 ces recommandations auxquelles Brama n\u2019a pas r\u00e9pondu.<\/p>\n<p>Ce faisant, elles sont devenues ex\u00e9cutoires en vertu du code de proc\u00e9dures du CPRST. Les clients nous ont cependant inform\u00e9s que Brama n\u2019avait pas rembours\u00e9 les montants surfactur\u00e9s. En tant que fournisseur de services participant, Brama a plusieurs obligations, dont celle d\u2019ex\u00e9cuter les recommandations et d\u00e9cisions. Brama a manqu\u00e9 \u00e0 ces obligations. Brama a \u00e9galement manqu\u00e9 \u00e0 ses obligations envers le CPRST en ne fournissant pas toutes les informations demand\u00e9es en lien avec ces plaintes, en ne coop\u00e9rant pas de bonne foi aux enqu\u00eates du CPRST sur ces plaintes et en ne payant pas au CPRST les montants factur\u00e9s en temps opportuns.
